Overview

It is MailHippo, Inc.’s policy to respect your privacy regarding the information that we collect while operating our business. This Privacy Policy applies to www.MailHippo.com(collectively, “us”, “we,” “MailHippo,” or the “Website”) and the secure email delivery services made available on the Website (the “Service”). We have adopted this privacy policy (“Privacy Policy”) to explain what information we may collect on our Website and through the Service, how we use this information, and under what circumstances we disclose the information to third parties. This Privacy Policy, together with the Terms of Service for Subscribers, set forth the general rules and policies governing your use of our Website and the Service. If you use the Service, you may be required to agree to additional terms and conditions.

The Information We Collect

We collect information through our Service, which allows our Subscribers to send emails to their Recipients. We also collect information from Website Visitors. In this Privacy Policy, we use the following definitions for those terms:

A “Recipientis a person a Subscriber may contact through our Service.

“Subscriber” means any person or entity that uses or is considering using the Service, or a person acting on an entity’s behalf to use the Service.

“Website Visitor” means any person who uses the Website.

We may collect certain information from or about you, whether you are a Subscriber, a Recipient, or a Website Visitor, that can be used to uniquely contact, identify, or locate you (“Personal Information”).

Subscribers

If you are a Subscriber, the categories of Personal Information that we collect from you may include:

- Business contact information and contact preferences (such as your name, organization, phone number, email address, and country);
- Account log-in and other credentials (such as your email address and password when you sign up for an account with us; signature credentials; and authentication questions and answers);
- Support history that you provide or we otherwise collect in connection with support questions we receive from you;
- Online browsing information (such as IP address and geolocation);
- Payment information (including your credit card numbers and associated identifiers and billing address);and
- Use of the Service and other account activity (such as email subject lines used, attachment file names, records accessed or created; and email signatures).

We use each of those categories of Personal Information to set up and manage your account, and otherwise operate our business (as described in further detail below).

We may also automatically collect information, some of which may qualify as Personal Information, about your use of the Service.

Recipients

Subscribers may provide information about Recipients to us through the Service. For example, Subscribers may provide us with Personal Information about you such as your name and email address. We may also automatically collect limited information about your interaction with the Service.

However, please note that we do not regularly access the contents of the communication between Subscribers and Recipients, as we instead provide a secure means for the delivery of that communication except that we do access email contents while providing customer-support services.

Website Visitors

Like most website operators, we collect data, that is not typically identifying, of the sort that web browsers and servers often make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting that information is to better understand how Website Visitors use our Website and to market our Service. From time to time, we may use and disclose non-personally-identifying information, such as aggregate information, about Website usage. We may also collect certain information that may be Personal Information, such as Internet Protocol (IP) address. Please see the “Cookies” section below for further details.

How Do We Use The Information That We Collect?

MailHippo and our third party services providers use the Personal Information that we collect to operate the Website and deliver the Service, including to improve the user experience and address Website integrity or security issues. With respect to our Subscribers, we may send you information that you request from us, and promotional materials regarding MailHippo. Additionally, we may retain and use certain Personal Information to address inquiries or requests regarding the Service from Subscribers and Website Visitors. We may also use Personal Information as necessary to ensure compliance with any internal policies and any applicable law, regulation or order.

Except as described elsewhere in this Privacy Policy, we will not use your Personal Information unless:

1. you expressly authorize us to do so,
2. it is necessary to allow our service providers, agents, or other third parties to provide products or services for or to us,
3. it is necessary in order to provide the Website or the Service,
4. we are sending you other information that may be useful to you or to provide more information about the Service,
5. subject to applicable contractual or legal restrictions, it is disclosed to entities that perform marketing services on MailHippo’s behalf or to other entities with whom MailHippo has joint marketing agreements,
6. it is necessary to protect the security or integrity of the Service or Website,
7. it is necessary in connection with other business purposes including, without limitation, verifying identity, age, and/or payment details, investigating complaints about the Service or Website, risk assessment, fraud and crime prevention/detection, monitoring, research and analysis, marketing, customer purchasing preferences and trends and dispute resolution,
8. it is necessary to comply with law enforcement, governmental mandate, or other legal requirement, if appropriate, for your protection, in connection with an investigation or prosecution of possible unlawful activity or to enforce our legal rights or the rights of a third party; or
9. subject to applicable contractual or legal restrictions, it is necessary in connection with a sale of all or substantially all of the assets of MailHippo or the merger of MailHippo into another entity or any similar transaction.

With Whom Do We Share Information That We Collect?

We may share all of the categories of Personal Information that we collect with our third party service providers to operate our business. For example, we share some of our Subscribers’ Personal Information with third party payment processors in order to process subscriptions.

We do not sell our Subscribers’ or Recipients’ Personal Information. As described in detail below, we may make some data generated by Website Visitors, some of which may qualify as Personal Information, available to third parties through online tracking tools.

We may also disclose any of the categories of Personal Information that we collect if we become subject to a subpoena or court order, or if we are otherwise legally required to disclose the information. We may also use and disclose Personal Information to establish or exercise our legal rights, to enforce agreements between us and our Subscribers, to assert and defend against legal claims, or if we believe such disclosure is necessary to investigate, prevent, or take other action regarding actual or suspected illegal or fraudulent activities or potential threats to the physical safety or well-being of any person.

As we grow and develop our business, it is possible that our corporate structure or organization might change or that we might merge or otherwise combine with another company. In any such transactions, customer information generally is, and should be expected to be, one of the transferred business assets. Also, if any bankruptcy, liquidation or reorganization proceeding is brought by or against us, certain Personal Information may be considered a company asset that may be sold or transferred to third parties.

Ads appearing on our Website, if any, may be delivered to users by our third-party advertising partners who may set cookies or other online tracking tools. These cookies allow the advertiser to recognize your device each time they send you an online advertisement to compile information about you or others who use your computer. This information allows advertisers and advertising networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you.

Our Website may contain links to external sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s website. We strongly advise you to review the privacy policy and terms and conditions of every website you visit. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third party websites, products or services.

Marketing Services and Remarketing

MailHippo may use remarketing services to advertise on third party websites to previous Website Visitors. Third-party vendors, including Google, use cookies or other tracking technologies to serve advertisements based on a consumer’s online behavior. You can set preferences for how Google advertises to you using the Google Ad Preferences page.

Protection of Certain Personal Information

MailHippo takes commercially reasonable measures to secure and protect information transmitted via or stored on the Website or Service. Nevertheless, no security system is impenetrable. Please immediately notify us of any breach of the Service’s security or this Privacy Policy of which you become aware.

Aggregated Statistics

We may collect statistics about the behavior of Website Visitors. We may display this information publicly or provide it to others. However, MailHippo does not connect such information to any specific individual.

Children

The Website and Service are intended for a general audience and are not intended for use or view by children under 18 years of age, and we do not knowingly collect information about children or sell products to children. We will not knowingly collect any information from children under the age of 18.

Do Not Track Requests

Certain State laws require that we indicate whether we honor “Do Not Track” settings in your browser concerning targeted advertising. We adhere to the standards set out in this Privacy Policy and do not monitor or follow any Do Not Track browser requests.

Cookies

MailHippo uses cookies and similar technologies and services provided by third parties. A cookie is a string of information stored on a Website Visitor’s computer, and that the Website Visitor’s browser provides to the Website each time the Website Visitor returns.

MailHippo may use cookies to gather information about Website Visitors’ use of the Website and our Subscribers’ use of the Service for several reasons, including, but not limited to, the following: statistics collection and analysis, Website and Service optimization, advertising (as described above), and market research. The information that we and our third party service providers track with cookies includes, but is not limited to, the type of browser (such as Google Chrome or Internet Explorer) and device being used to access the Website, your Internet protocol (“IP”) address, your home domain or Internet service provider, your referrer URL, which specific pages you access on the Website or Service, the time and date you access our Service and the total number of visitors to the Website and any portions thereof. Retention Period

We retain the Personal Information that we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with the Service you requested or to comply with an applicable legal requirement). As such, we generally retain records relating to the Service for a period of seven years, unless a Subscriber requests that we destroy a record ahead of our scheduled destruction.

Although most changes are likely to be minor, MailHippo may change our Privacy Policy from time to time, and in MailHippo’s sole discretion. We may inform you of any material changes through any reasonable means, such as an email or message through the Service. The “Last Updated” date posted at the top of the Privacy Policy reflects the effective date of the most recent version. MailHippo encourages you to frequently check this page for any changes to our Privacy Policy.

General Information about Data Privacy Rights

Depending on the country in which you reside, you may have the following data protection rights:

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may ask you to verify your identity in order to help us respond efficiently to your request. In certain circumstances, you may also make a request through an authorized agent.

California Privacy Rights

This Section provides information about the California Consumer Privacy Act (CCPA), as it may be amended. The CCPA provides consumers with specific rights regarding their Personal Information. The CCPA currently exempts Personal Information reflecting a written or verbal business-to-business communication (“B2B Personal Information”) from certain of the law’s requirements, and also currently exempts personal information collected and used about a natural person acting as a business’s employee or contractor (“Personnel Information”). The rights described below may not apply to B2B Personal Information or Personnel Information.

You have the right to request that businesses that are subject to the CCPA (which may include some of our Subscribers) to disclose certain information to you about their collection and use of your Personal Information. In addition, you have the right to ask such businesses to delete Personal Information collected from you, subject to certain exceptions. If a business sells personal information, you have a right to opt-out of that sale. Businesses may not discriminate against you for exercising any CCPA rights, such as the access and deletion rights described above.

We typically act as a “service provider,” as that term is defined under the CCPA, as our receipt and collection of any consumer Personal Information is done on behalf of our Subscribers in order for us to provide the Service. Under those circumstances, please direct any requests for access or deletion of your personal information under the CCPA to the business or utility with which you have a direct relationship.

Data Subjects in the European Economic Area (“EEA”)

Legal Bases of Processing and Related Information

If you are located in the EEA, Switzerland or UK, our legal basis for collecting and using the Personal Information described above will depend on the Personal Information concerned and the specific context in which we collect it.

If you are a Subscriber, we may need Personal Information to perform a contract to which you are a party, and may need that Personal Information to deliver the Service. In some limited cases, we may also have a legal obligation to collect Personal Information from you. If we rely on consent as a basis of processing, you have a right to revoke that consent at any time.

However, we will normally collect and use Personal Information from you where the processing is in our legitimate interests and not overridden by your data-protection interests or fundamental rights and freedoms. Our legitimate interests typically include improving, maintaining, providing, and enhancing the Service; ensuring the security of the Service and our Website; and supporting our marketing activities. We do not engage in automated decision making.

Acting as a Processor

We may act as a processor on behalf of our Subscribers. In such cases, if you are a Recipient and want to exercise any data protection rights that may be available to you under applicable law or have questions or concerns about how your Personal Information is handled by, you should contact the relevant Subscriber that is using the Service, and refer to their separate privacy policies.

If you no longer want to be contacted by one of our Subscribers through our Service, please unsubscribe directly from that Subscriber or contact the Subscriber directly to update or delete your data.
